International Commercial Arbitration
The course deals with the role of international commercial arbitration is the settlement of commercial disputes as an alternative to the litigation at state courts. After a brief outline of the history of arbitration it focuses on the arbitration agreement as the source of the authority of arbitration, deals with the question of arbitrability, the characteristics of the legal relationships between the parties and the arbitrators, the construction of the arbitral tribunal, the conduct of arbitral proceedings and the relevant private international law related questions of arbitration. It also analyses the role of the different guidelines issued by the International Bar Assotiation conecrning international arbitration. It gives an overwiev of the main international and internal sources of arbitration with special regard to the New-York Convention and the role of the Uncitral Model Law in the harmonisation of national arbitration laws. Finally it introduces the students the different approaches concerning the theory of international arbitration.
Students are required to bear witness of their acquired knowledge by a written test at the end of the course.
International Family Relations
The purpose of this course is to analyze in detail different topics of international family law, in particular international marriage, divorce and personal separation, parental responsability, child abduction etc.
It offers an analysis of the legal background, the main trends in the recent case law of the European Court of Justice and European Court of Human Rights, and the future perspectives on EU and international level.
Students are required to pass a written test at the end of the course.
